1.
How to Enter: The Bastian Carpet One
Lehigh Valley Flooring Makeover Sweepstakes (the “Sweepstakes”) begins
at 12:00 a.m. Eastern Time (“ET”) on 08/05/09 and ends at 11:59 p.m.
ET on 11/05/09 (the “Sweepstakes Period”). To enter, visit www.WinwithBastian.com (the “Web Site”), fill in the online entry
form, submit it in accordance with the on-screen directions during the
Sweepstakes Period, and you will be entered. Limit one (1) entry per
person and per email address for the entire Sweepstakes Period. Entries
received from the same person or email address on any given day after the
first entry received from that person or email address on that day will be
void. For the purposes of these Official Rules, a day begins at 12:00 a.m.
ET and ends at 11:59 p.m. ET. Entries must be received by 11:59 p.m. ET on
11/05/09 to be eligible. Entries generated by script, macro or other
automated means and entries by any means which subvert the entry process
will be void. All entries submitted become the sole property of Sponsor
and will not be acknowledged or returned.
2.
Eligibility: To enter the
Sweepstakes, you must be a legal resident of the 50 United States or the
District of Columbia and be 21 years of age or older. Sweepstakes is void
in Puerto Rico, other U.S. territories, possessions and commonwealths, and
where restricted or prohibited by law. The Sweepstakes, and any web site
pages and advertisements relating thereto, is intended for viewing only
within the United States. You are not authorized to participate in the
Sweepstakes if you are not located as
a resident of the Lehigh Valley in the Commonwealth of Pennsylvania. Employees of Bastian Carpet One
(“Sponsor”), and Viamedia LLC (“Sweepstakes Administrator”), and
their respective affiliated companies, parents, subsidiaries and
advertising and promotion agencies (collectively, “Sweepstakes
Entities”), and their immediate families (spouse, parent, child, sibling
and their respective spouses, regardless of where they reside) and members
of their households, whether or not related, are ineligible to participate
in this Sweepstakes.
3.
Drawing and Notification: Potential Grand Prize
Winner will be selected from all eligible entries received in a random
drawing held on or about 11/06/09 by Sweepstakes Administrator, an
independent judging organization whose decisions are final and binding in
all respects. Odds of winning the Grand Prize depends upon the number of
eligible entries received. The potential Grand Prize Winner will be
notified by phone, email and/or mail. If potential Grand Prize Winner
cannot be reached within two (2) days from the date of the first
notification attempt, he/she shall be disqualified and, at Sponsor’s
discretion, an alternate Winner will be selected.
4.
Grand Prize (1): $1000.00 in-store
credit at Bastian Carpet One for future purchases of carpeting, flooring
or area rugs. No substitutions are allowed. Four
second prize winners will receive $25 Texas Roadhouse gift cards.
Prize Winner(s) will be
responsible for all necessary travel authorizations and travel insurance,
if any. Winner(s) are solely responsible for any applicable fees, and all
insurance, federal, state and local taxes, if any, and any other
unspecified costs and expenses associated with acceptance or use the prize
(including flights). Sweepstakes Entities are not liable for any expenses
incurred as a consequence of the event or delays. Winner(s) and must be 21
years of age or older, unless guest is child or legal ward of Winner. Gift
Certificates are subject to terms and conditions as specified by issuers.
Prize(s) are awarded “as is” with no warranty or guarantee either
express or implied by Sponsor. Total Approximate Retail Value of Grand
Prize: $1000. Actual value may vary.
All costs, fees, and expenses associated with the acceptance and use of
the prize not specifically specified herein as being provided are the sole
responsibility of the Grand Prize Winner, including any transportation
costs, airline baggage fees, additional meals, gratuities and souvenirs.
All federal, state, and local taxes are the Grand Prize Winner’s
responsibility. All prize details are at the sole discretion of the
Sponsor. Sponsor reserves the right to substitute the prize (or portion
thereof) with one of comparable or greater value, at its sole discretion.
The Grand Prize cannot be transferred or substituted or redeemed for cash
(if non-cash prize) except at Sponsor’s sole discretion.
5.
Prize Conditions: If Sponsor is unable to
contact the potential Grand Prize Winner within two (2) days of the
initial contact attempt, if the prize notification is returned as
undeliverable, if potential Grand Prize Winner fails to complete and
return all requested forms within seven (3) days of date of issuance, if
potential Grand Prize Winner is found to be ineligible, if he/she does not
comply with the Official Rules, or if the potential Grand Prize Winner
fails to comply with any of the requirements set forth herein, his/her
prize will be forfeited and, at Sponsor’s discretion, an alternate Grand
Prize Winner shall be selected. Except where prohibited by law, the Grand
Prize Winner’s entry and acceptance of the Grand Prize constitutes
permission for the Sweepstakes Entities and their respective designees to
use said Grand Prize Winner’s name, photograph, likeness, statements,
biographical information, voice, and city and state address on a worldwide
basis, and in all forms of media, now or hereafter devised, in perpetuity,
without further compensation, notification or permission.
6.
Sweepstakes Conditions:
This Sweepstakes is subject to all applicable federal, state and local
laws. By participating, entrants agree to be bound by these Official Rules
and the decisions of the Sponsor and Sweepstakes Administrator, which
shall be final and binding and waive any right to claim ambiguity in the
Sweepstakes or these Official Rules. Entrants also agree to release,
discharge, indemnify and hold harmless the Sweepstakes Entities and each
of their respective officers, directors, employees, representatives and
agents (collectively, “Released Parties”) from and against any claims,
damages or liability due to any injuries, damages or losses to any person
(including personal injury or death) or property of any kind resulting in
whole or in part, directly or indirectly, from acceptance, possession,
misuse or use of the Grand Prize (including any travel/activity related
thereto) or participation in any Sweepstakes-related activity or
participation in this Sweepstakes, or any claims based on rights of
publicity, rights of privacy and/or merchandise delivery.
7.
Limitations of Liability:
In case of dispute as to the identity of any online entrant, entry will be
declared made by the authorized account holder of the email address
submitted at time of entry provided he/she is eligible according to these
Official Rules. “Authorized Account Holder” is defined as the natural
person who is assigned an email address by an Internet access provider,
online service provider, or other organization (e.g., business,
educational, institution, etc.) responsible for assigning email addresses
or the domain associated with the submitted email address. Potential Grand
Prize Winner may be requested to provide Sponsor with proof that such
Grand Prize Winner is the authorized account holder of the email address
associated with the winning entry. Released Parties are not responsible
for late, lost, damaged, misdirected, incomplete, delayed, undeliverable,
garbled, destroyed or inaccurate entries due to system errors or failures,
or faulty transmissions or other telecommunications malfunctions and/or
entries not received resulting from any hardware or software failures of
any kind, lost or unavailable network, cable, satellite, Internet Service
Provider or other connections, or failed, incomplete or garbled computer
transmissions, typographical or system errors and failures, or faulty
transmissions, or for any errors, problems or malfunctions whether
technical, computer, network, telephonic, mechanical, typographical,
printing, human or otherwise, including any errors, problems or
malfunctions which may occur in connection with the administration of the
Sweepstakes, the processing of entries, the announcement of the prize or
in any Sweepstakes-related materials. Sponsor may prohibit an entrant from
participating in the Sweepstakes or winning the Grand Prize if, in its
sole discretion, it determines that said entrant is attempting to
undermine the legitimate operation of the Sweepstakes by cheating,
hacking, deception, or other unfair playing practices (including the use
of automated quick entry programs) or intending to annoy, abuse, threaten
or harass any other entrants or Sponsor representatives and void all
associated entries. If for any reason this Sweepstakes is not capable of
running as planned, including, but not limited to, infection by computer
virus, bugs, tampering, unauthorized intervention, fraud or any other
causes which corrupt in any way or affect the administration, security,
fairness, integrity, fulfillment or proper conduct of the Sweepstakes,
then Sponsor reserves the right at its sole discretion to cancel,
terminate, modify or suspend the Sweepstakes and, in the event of
cancellation or termination, select the Grand Prize Winner by randomly
drawing from those eligible, non-suspect entries received up to the
cancellation/termination date. CAUTION: ANY ATTEMPT BY AN ENTRANT TO
DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF
THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD
SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND
DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH ENTRANT TO THE FULLEST
EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
8.
Rules/Winner’s Name: To receive the Grand
Prize Winner’s name or an additional copy of these Official Rules, send
a self-addressed, stamped envelope to: The Bastian Carpet One Lehigh
Valley Flooring Makeover Sweepstakes, c/o Viamedia LLC, 3910 Adler Place,
Suite 100, Bethlehem, PA 18017. Please specify “Rules” or
“Winner’s Name.” Winner’s Name will be available after 11/15/09.
Requests received after 11/05/09 will not be honored. The Official Rules
are also available on the Web Site.
